1.About these Terms
Using OmatologyTech means you agree to these Terms.
- 1.1
These Terms of Service (“Terms”) are a binding agreement between you and OmatologyTech Limited (“OmatologyTech”, “we”, “us”), a company based in Lagos, Nigeria. They apply to omatologytech.com and every course, product, appointment booking and feature we offer (together, the “Platform”).
- 1.2
By creating an account, making a purchase or otherwise using the Platform, you confirm that you have read and accepted these Terms. If you act for an organisation, you confirm you have authority to bind it.
- 1.3
Some features have extra rules, such as instructor terms or a specific product licence. Where those conflict with these Terms, the more specific rule applies to that feature.
2.Your account
Keep your details accurate and your password private.
- 2.1
You must be at least 18 to open an account. If you are younger, a parent or legal guardian must set up and supervise the account and accepts these Terms on your behalf.
- 2.2
Give accurate details and keep them up to date. You are responsible for activity on your account, so tell us straight away if you suspect someone else has used it.
- 2.3
One person, one account. Do not share your login or resell access. We may limit simultaneous sessions to protect course content.
- 2.4
If you sign in with Google or GitHub, the account is still subject to these Terms.
3.Acceptable use
Be honest, respect others and don’t copy or redistribute paid content.
- 3.1
You agree not to:
- copy, record, redistribute or resell course videos, lessons, downloads or source code, except as your licence allows;
- share your account or purchased access with other people;
- upload unlawful, infringing, defamatory, hateful or misleading content;
- probe, overload or break the Platform, bypass access controls, or scrape it in bulk;
- send spam or malware, or harass other users or our staff;
- post fake reviews, or manipulate ratings, coupons or referral rewards;
- claim certificates or credentials you did not earn.
- 3.2
We may remove content and restrict accounts that break these rules, as described in “Suspension and termination”.
4.Orders and payment
Prices are in naira and access starts when your payment is confirmed.
- 4.1
Prices are shown in Nigerian Naira (₦) unless stated otherwise and include any taxes we are required to charge. We may change prices at any time; the price shown when you place your order is the price you pay.
- 4.2
Payments are processed by third-party providers such as Paystack, Flutterwave and OPay. We do not see or store your full card details. Your order is complete once the provider confirms your payment to us, and access is then granted automatically. If you were charged but did not get access, contact us with your payment reference and we will resolve it.
- 4.3
Coupons and promotions apply only to the courses or products they name, may expire or have usage limits, cannot be exchanged for cash, and can be withdrawn if misused.
- 4.4
You confirm you are authorised to use the payment method you select. We may cancel or refuse an order we reasonably suspect is fraudulent or placed by mistake, and will refund anything already taken.
5.Courses and certificates
Courses are licensed for your own learning, not for sharing.
- 5.1
When you enrol in a course you receive a personal, non-exclusive, non-transferable licence to view it for your own learning. “Lifetime access” means access for as long as the course remains on the Platform. We may update or retire a course, and will give reasonable notice where practical, including when a course is withdrawn for legal or safety reasons.
- 5.2
Courses are created by independent instructors or by us. Instructors are responsible for the accuracy of their content. We review courses before they are published but cannot guarantee every outcome.
- 5.3
A certificate is issued when you complete all required lessons and carries a unique number so others can verify it. We may revoke a certificate obtained by cheating or in breach of these Terms.
- 5.4
Live sessions and appointments depend on the host’s schedule. We may reschedule with reasonable notice.
6.Digital products and licences
Source code, eBooks and templates are licensed for your own projects, not for resale.
- 6.1
Digital products such as source code, eBooks, templates, audio and video bundles are licensed, not sold. Unless a product page says otherwise, your purchase gives you a personal, non-exclusive, non-transferable licence to use the product in your own projects, including projects you build for clients. You may not redistribute, resell, sublicense or publish it, on its own or inside a competing product or template.
- 6.2
Downloads may be limited (currently up to 5 per purchase) and links can expire, so keep your own copy once downloaded.
- 6.3
Source code is provided as described on its product page. Unless we agree in writing, it does not include installation, customisation or ongoing support.
7.Refunds and cancellations
Courses can be refunded within 7 days if you have barely started. Downloads can’t be refunded once downloaded, unless faulty.
- 7.1
Courses: you can request a refund within 7 days of purchase if you have completed no more than 20% of the course.
- 7.2
Digital products: because they can be copied once delivered, downloadable products are not refundable after the first download, unless the file is faulty, materially different from its description, or could not be delivered.
- 7.3
If something goes wrong, such as a duplicate charge, failed delivery or a course that does not work as described, contact us and we will fix it or refund you.
- 7.4
Approved refunds are paid to the original payment method and can take several business days to reach you, depending on your bank or provider. Access to a refunded item ends when the refund is issued.
- 7.5
Nothing in this section limits rights you have under consumer protection law, including the Federal Competition and Consumer Protection Act 2018.
8.Instructor terms
If you teach here, you keep your content, we handle sales, and you earn a share of each sale.
- 8.1
To teach on the Platform you must apply and be approved. We may approve, reject or suspend applications at our discretion and will give a reason where we reasonably can.
- 8.2
You keep ownership of the content you create. You give us a worldwide, non-exclusive licence to host, display, promote and distribute it on the Platform (including previews, thumbnails and marketing) while it is listed, and for a reasonable period afterwards so students who already enrolled can keep learning.
- 8.3
You promise your content is original or properly licensed, does not infringe anyone’s rights, and is accurate and not misleading. You are responsible for claims arising from it.
- 8.4
New and materially updated courses are submitted for review before publishing. We may ask for changes, or reject, unpublish or archive a course that does not meet our quality, legal or safety standards.
- 8.5
Revenue share: you earn 70% of each sale of your course after applicable platform and payment fees, as shown in your dashboard. Coupons created by our administrators do not reduce your payout rate.
- 8.6
Earnings become withdrawable once released and are paid to the payout details you provide. You are responsible for keeping those details correct and for any tax due on your earnings. We may withhold or reverse earnings linked to refunds, chargebacks, fraud or breaches of these Terms.
9.Content you submit
You own what you post; we may display it to run the Platform.
- 9.1
You own what you submit, such as reviews, comments, assignments and profile information. You give us a non-exclusive, royalty-free licence to host and display it on the Platform as needed to run it.
- 9.2
Reviews must reflect your genuine experience. We may hide or remove reviews that are abusive, off-topic, spam or fake. We do not edit what a review says.
- 9.3
If you believe something on the Platform infringes your copyright, contact us with details of the work and where it appears, and we will look into it promptly.
10.Our intellectual property
The Platform and brand are ours; course content belongs to its creator.
- 10.1
The Platform, our name, logo, design, software and the materials we create belong to OmatologyTech Limited or our licensors and are protected by copyright and other laws. These Terms give you no rights in them beyond using the Platform as intended.
- 10.2
Course and product content stays the property of its creator. Your licence to it is limited as described in these Terms.
11.Third-party services
Payments, video hosting and sign-in run on other companies’ services.
- 11.1
The Platform relies on third-party services such as payment providers, video and file hosting, email delivery, and sign-in with Google or GitHub. Their own terms and privacy policies apply when you use them, and we are not responsible for their availability or conduct. Links to outside sites are for convenience; we do not control or endorse them.
12.Privacy and communications
We handle your data under Nigerian law and explain how in our Privacy Policy.
- 12.1
We handle personal data in line with the Nigeria Data Protection Act 2023. Our Privacy Policy explains what we collect, why, how long we keep it and the rights you have.
- 12.2
The Platform uses cookies to keep you signed in and to keep your account secure.
- 12.3
We send service emails such as receipts, password resets and course updates. Marketing emails are optional and you can opt out at any time.
13.Availability and disclaimers
We do our best, but can’t promise the Platform never has problems or guarantee outcomes.
- 13.1
We work to keep the Platform available but cannot promise it will be uninterrupted or error-free. We may update, suspend or discontinue features for maintenance, security or legal reasons.
- 13.2
Our training is educational. We do not promise a particular result, such as a job, promotion, income or exam outcome. Your progress depends on your own effort and circumstances.
- 13.3
Except where the law says otherwise, the Platform and its content are provided “as is” and “as available”, without warranties of fitness for a particular purpose or that content is free of errors.
14.Limits of liability
Our liability is capped at what you paid, except where the law doesn’t allow it.
- 14.1
To the fullest extent permitted by law, OmatologyTech is not liable for indirect or consequential loss, or for loss of profit, revenue, data or opportunity arising from your use of the Platform.
- 14.2
Our total liability for a claim relating to a purchase is limited to the amount you paid for the course or product the claim relates to.
- 14.3
Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence, or limits your statutory consumer rights.
- 14.4
You agree to compensate us for losses we suffer because you breached these Terms or used the Platform unlawfully.
15.Suspension and termination
You can leave any time; we can act if these Terms are broken.
- 15.1
You can close your account at any time by contacting us. Closing it does not by itself entitle you to a refund, so download anything you are entitled to keep first.
- 15.2
We may suspend or close accounts, remove content or withdraw access if you breach these Terms, put others or the Platform at risk, or where the law requires. Where reasonable, we will tell you why and let you respond. Fraud, chargeback abuse and serious or repeated breaches may lead to immediate action.
- 15.3
Sections that by their nature should continue after termination, including licences to content, intellectual property, limits of liability and governing law, will continue.
16.Governing law and disputes
Nigerian law applies. Talk to us first; Lagos courts handle what we can’t resolve.
- 16.1
These Terms are governed by the laws of the Federal Republic of Nigeria.
- 16.2
If you have a complaint, please contact us first. We will try to resolve it in good faith within 30 days. If it cannot be resolved, the courts of Lagos State have jurisdiction, unless mandatory consumer law lets you bring proceedings elsewhere.
- 16.3
If any part of these Terms is found unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it. These Terms are the entire agreement between you and us about the Platform.
17.Changes and contact
We’ll post updates here and tell registered users about material changes.
- 17.1
We may update these Terms as our services or the law change. For material changes we will post the new version here with an updated date and notify registered users by email or in the app. Using the Platform after changes take effect means you accept them.
- 17.2
